Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered December 9, 2003, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.
On December 31, 2002, a home in the City of Kingston, Ulster County, was burglarized and credit cards were stolen. The next day the owners reported to police that the cards had been used at the ATM of a nearby gas station.
