Original Proceedings in Mandamus. Proceeding in this court to compel a justice of the peace to issue an execution upon a judgment rendered by him. The petition herein was filed July 23,1886, and the opinion at the session of the court in December, 1887.

This is an original proceeding upon mandamus, to compel the issuance of an execution upon a judgment by a justice of the peace of Cowley county. From the alternative writ, and the answer, we learn that the judgment was rendered on June 12, 1886, by W. D. Kreamer, a justice of the peace, in an action of replevin, wherein C. M. Scott was *754plaintiff and P. S. Burress was defendant. The trial was had with a jury, and a verdict rendered in favor of Scott for the possession of a horse, valued at $75; and judgment in accordance with the verdict…
