MEMORANDUM OPINION AND ORDER
ALBRITTON, Chief Judge.
I. INTRODUCTION
This cause is before the court on a Motion for Summary Judgment, filed by Defendants Hartz Seed Company (“Hartz”) and Monsanto Company (“Monsanto”) (collectively, the “Defendants”) on July 28, 2000 (doc. # 49).
Moorer Seed Company (“MSC”) and Melvin M. Moorer, Jr. (“Moorer, Jr.”) (collectively, the “Plaintiffs”) originally filed their Complaint in the Circuit Court of Autauga County, Alabama on August 5, 1999, alleging various state law claims.
