I. INTRODUCTION
Disenchanted with the dealership decisions of its' national franchisor, plaintiff Bertera Chrysler Plymouth, Inc. (“Bertera”) started a civil action in Hampden County Superior Court on October 1, 1997 against the Chrysler Corporation (“Chrysler”) for several moving violations, inter alia, an infraction of Mass.Gen.Laws ch. 93B, breach of contract, breach of the implied covenant of good faith, and fraud.
