The Home Savings & Trust Company is a building and loan association organized under the laws of this state. In September of the year 1901, at a meeting *3of the stockholders, it was resolved to go into voluntary liquidation under a plan which contemplated the appointment of a trustee by the executive council of the state. Pursuant to this plan, one W. H. Bremner was appointed trustee, gave bond, and duly qualified as such. At the May, 1902, term of the district court of Polk county, W. A.
