Ron Swafford was convicted in the district court on one count of third-degree criminal sexual penetration, NMSA 1978, Section 30-9-11(0) (Repl.Pamp.1984), one count of incest, NMSA 1978, Section 30-10-3 (Repl.Pamp.1984), one count of aggravated assault with intent to commit a felony, NMSA 1978, Section 30-3-3 (Repl. Pamp.1984), and one count of false imprisonment. NMSA 1978, Section 30-4-3 (Repl.Pamp.1984). Following an unsuccessful appeal, Swafford v.
