MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

The presently incarcerated petitioner Thomas F. Green brings this petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 on the grounds (1) that he was denied his constitutional right to effective assistance of counsel and (2) prosecutorial misconduct. The Court finds that the Petitioner has established that he re*242ceived constitutionally inadequate assistance of counsel and that a “reasonable probability” exists that the outcome of the trial would have been different had he received effective assistance of counsel.
