In this action the plaintiff, Ellen Johnson, M.D. (“Dr. Johnson”), alleges that the defendant, ProSelect Insurance Company (“ProS-elect”), acted negligently and breached its duty of good faith in the defense of a medical malpractice action against Dr. Johnson by failing to investigate the case, properly evaluate the liability risks, and undertake pre-trial settlement negotiations.
