Appellant’s decedent filed an action against appellee in the court of a justice of the peace for the recovery of damages in the sum of two- hundred' dollars. The case was set for trial by agreement of the parties on a day of a regular term of the justice court, to wit, at 2 o’clock p. m., May 12, 1933. At that hour appellee, hereinafter to be called the defendant, and his attorney appeared and were ready for trial.
