(dissenting) : When this cause was first heard in this Court, Mr. Justice Stabler and I concurred in the opinion of Mr. Justice Cothran reversing the judgment below. My views are still in accord with that opinion, and I adopt it as my dissenting opinion from the judgment now proposed to be entered.
