Patricia Penn, an attorney licensed in the State of Tennessee, was charged in Crittenden County Circuit Court with interference with custody, a class D felony, under Ark. Code Ann. § 5-26-502. Penn filed a motion to dismiss on the grounds that her prosecution would violate the federal constitutional prohibition against double jeopardy. The circuit court denied the motion, and Penn appeals. We agree that the circuit court erred in denying the motion and reverse.
