This action was brought to quiet title to the east half of a certain donation land claim, situate in Thurston county, by appellant who claimed to be the owner in fee. The court found in favor of the respondents and this appeal was taken.

The respondents contend that this court cannot enter into an examination of the evidence introduced in said cause, and that the judgment must be affirmed, because the findings of fact and conclusions of law were not excepted to by the appellant.
