The plaintiff in error, hereinafter called the defendant, was convicted in the district court of Marshall county, of manslaughter in the first degree, and his punishment fixed at 15 years in the state penitentiary. Judgment was rendered on the 10th day of December, 1928, and the record was lodged in this court on June 29, 1929. The record discloses that no notice of appeal was served upon the county attorney or court clerk of the county in which the defendant was tried; that no summons in error has been issued and served, as provided by law, and the issuing and serving of the summons has not…
