Appeal from Macomb; Ersbine, J. Bill by Allen E. Macomber against George Cottrell and others, heirs at law of William Cottrell, deceased, to set aside an assignment of a claim, and for an accounting. From an order overruling a demurrer, defendants appeal.

The bill in this case is filed by the complainant to establish his claim as heir of one Georgia Macomber Cottrell to a share of her estate, which he alleges to have gone into the hands of William Cottrell, her hus*92band, who survived her, and for which, it is claimed, he never accounted. A demurrer to the bill was overruled, and defendants have appealed.

We must, of course, look at the bill and determine whether it states a case entitling complainant to relief. Briefly stated, the allegations are:(1) Georgia Macomber Cottrell was the sister of the complainant, and wife of William Cottrell, who…
