On June 28, 1921, the plaintiff and his wife executed and delivered to L. I. Hall, an agent of the defendant trust, the oil and gas lease on the lands involved. The lease was to run for five years with the right to renew it year by year thereafter by the payment each year of a consideration of $1 unless oil or gas were developed in the meantime of commercial value. At the same time the plaintiff executed and delivered to Hall for the defendant a mineral deed conveying 25 per cent, of “all gas, oil and minerals” in the same land in the event the lease was allowed to lapse.
