1. “1st. A receiver for a bank was appointed by a judge of the superior court, and gave bond which was approved on August 7, 1912, and which is as follows:
'. ‘Know all men by these presents, that the undersigned, James R. Armstrong as principal, and United States Fidelity & Guaranty Co. as surety, acknowledge ourselves held and firmly bound unto A. R. Walton, Ordinary of said County, and his successors in office, in the full sum of fifty thousand ($50,000)…
