OPINION

KENNEDY, Justice.

This is a workers’ compensation case. Jesus Hernandez brought suit against his employer’s workers’ compensation insurance carrier, Transamerica Insurance Company of Texas (TIC), for an incapacity caused by a back injury he sustained on January 4, 1985 while making a delivery for his employer, Ramirez Distributing Company. A jury found that Hernandez suffered a temporary total incapacity from January 4, 1985 through February 26, 1985, and a permanent partial incapacity after April 2, 1986.
