I. INTRODUCTION

This cause is before the court on a Motion for Summary Judgment (Doc. # 24) filed by the Defendant Commonwealth Life Insur- anee Company (“Commonwealth”) on September 2,1998.

The Plaintiff originally filed her Complaint in the Circuit Court of Butler County, Alabama, on January 20, 1998, bringing claims for fraud, suppression, deceit, conversion, breach of contract, and negligence or wantonness against Commonwealth and unnamed fictitious defendants.
