Chapman, J. —
Plaintiff in error, Ralph Rivers, and Julio Meana, Albert Rodrigues and Albert Wilson Laney, alias Ab DeLaney, were informed against on June 28, 1938, by the County Solicitor of Polk County, Florida, for breaking and entering a store in the night time with the intent to commit a felony, to-wit, grand larceny. The crime was alleged to have been committed on the 26th day of June, 1938. The record shows that Albert Rodrigues and Julio Meana upon arraignment entered pleas of guilty, while Ralph Rivers and DeLaney filed pleas of not guilty and were placed upon trial and a verdict of…
