CHAPMAN, J.:

The appellant, Charles B. Savage, on November 21, 1941, was indicted by a Dade County grand jury for the crime of murder in the first degree. The indictment alleged that Charles B. Savage, on April 1, 1941, unlawfully and from a premeditated design to effect the death of Hannah Ford, alias Hannah Savage, did kill and murder her by submerging her beneath the water, thereby drowning, strangling and suffocating her.
