Appeal from an order of the Supreme Court (Demarest, J.), entered July 14, 2006 in St. Lawrence County, which granted defendant’s motion for summary judgment dismissing the complaint.
Plaintiff commenced an action against defendant in 1999 (hereinafter referred to as the first action) asserting numerous causes of action arising from defendant’s alleged failure to properly construct a home for plaintiff.
