KOELTL, District Judge:

This is an action alleging violations of 42 U.S.C. § 1983 and New York State .law by several New York City Police Officers, the City of New York, and the New York City Police Commissioner. The defendants move pursuant to Fed.R.Civ.P. 12(b)(6) to dismiss this action on several grounds. First, the defendants claim that the plaintiffs claims that he was unlawfully stopped, wrongfully arrested, and subjected to an unreasonable search are barred by the doctrine of collateral estoppel.
