This case involves the single question of whether subsection (l)(e) of Section 18-9-111, 1 C.R.S. 1973, is overbroad in its proscription and there fore facially unconstitutional under the First and Fourteenth Amendments to the United States Constitution and Article II, Section 10 of the Colorado Constitution.
