LALLY-GREEN, J.:

¶ 1 Appellant, John Ross, appeals from the denial of his “Petition to File Appeal Nunc Pro Tunc.” The trial court dismissed the petition as an untimely second PCRA petition. We reverse.

¶ 2 The procedural history of the case is as follows. On December 9, 1988, after a non-jury trial, Appellant was convicted of third degree murder and possessing an instrument of crime.
