Appeal from a judgment of the Supreme 'Court at Special Term, entered May 12, 1971 in Albany County, which dismissed petitioner’s application in a proceeding under CPLR article 78, to annul a determination of the Civil ¡Service Commission disapproving petitioner’s application for advancement to the position of Medical Specialist III. Appellant, a physician specializing in neurosurgery, is employed as a Medical Specialist II in the Department of Mental Hygiene.
