The defendant was convicted upon two indictments tried concurrently before a jury in the court below, which charged him with the embezzlement of certain funds entrusted to him as an agent for the purpose of building an apartment house in Honolulu for his principal. The defendant has brought his appeal to this court, specifying thirty-five assignments of error, all of which have been carefully studied.
