Appeal from a judgment of the County Court of Albany County (Herrick, J.), rendered February 2, 2015, upon a verdict convicting defendant of the crimes of rape in the first degree and criminal sexual act in the first degree (two counts).
On the evening of July 25, 2010, the victim was sexually assaulted while outdoors feeding cats in the City of Albany. The victim escaped from her assailant, who fled before police arrived and could not be located.
