The circuit court of Livingston county sustained the demurrer of appellees to the amended bill of appellants filed in that court for the assignment of dower and homestead to the appellee Nancy C. Applegate, widow of George W. Apple-gate, in the east half of the north-west quarter of section 24, township 30, range 4, in said county, and for the partition of the same between the heirs of said George W. Applegate. Appellants elected to stand by their amended bill, and it was dismissed at their cost.
