Before the Court are the parties’ cross motions for summary judgment in this declaratory judgment action. Plaintiff Canal Insurance Company (“Canal”) moves for summary judgment on the issue of whether the underlying wrongful death action is covered by the basic automobile liability insurance policy Canal provided to defendant Woodrow Sherman d/b/a Sherman Trucking Company (“Sherman”).
