In November, 1885, be made final proof, and December12,1885, tbe local land officers issued to him a final receipt. January 11, 1886, be executed a mortgage on tbe land, and tbe Valley Loan & Trust Company, plaintiff below and tbe defendant in error, claims as purchaser at a foreclosure sale under this mortgage.
