On December 21,1910, while the appellee, Willard Burk, was attempting to drive a team of horses across appellant’s track in the city of Greenville, he was thrown from the wagon and sustained the personal injuries for which he sues in this action. This is the second appeal in this case. A full statement of the material facts will be found in the opinion rendered by Justice Talbot in 146 S. W. 600.
