OPINION OF THE COURT

2Per curiam

Respondent William B. Gaits was admitted to the practice of law in the State of New York by the Second Judicial Department on May 8, 1975. At all times relevant to these proceedings, respondent has maintained an office for the practice of law within this Department.

On April 6, 2007, following a bench trial in Queens County, Criminal Court, respondent was convicted of attempted assault in the third degree (Penal Law §§ 110.00, 120.00 [1] [intent to cause physical injury]) and harassment in the second degree (Penal Law § 240.26).
