This was an action by David Heath against *496Barton Williams, to quiet the title to certain lands. The complaint alleges, in substance, that on the 24th of February, 1858, Williams sold and conveyed to him by warranty deed in fee, three hundred and sixty acres of land; that he went into immediate possession of it, and made lasting improvements thereon, &c.; but thatWilliams claimed the conveyance to be only a mortgage, and threatened suit for redemption, &c. .
