Plaintiff in error was convicted of tire crime of murder at the January term, 1907, of the Sangamon county circuit court and sentenced to the penitentiary for a term of forty years. The indictment charges that on May 7, 1906, he shot and killed his wife, Lulu Casey, with a revolver. The testimony was not preserved by a bill of exceptions, but it is set out therein that some fourteen witnesses testified that plaintiff in error shot and instantly killed Lulu Casey, his wife, at their home in Springfield.
