Defendant and Counter-Plaintiff Amerix Corporation (“Amerix”) filed a motion for partial summary judgment against Plaintiff and Counter-Defendant ACE American Insurance Company (“ACE”) on counterclaims VII through X of its Amended Counterclaim filed on November 5, 2007.
