James Moore (hereinafter, “Appellant”) appeals his conviction for felonious restraint in violation of Section 565.120 RSMo (2000) 1 and misdemeanor assault in the third degree in violation of Section 565.070 following a jury trial. Appellant was sentenced to concurrent terms of ten years imprisonment for the felonious restraint conviction and one year for the assault conviction.
