HARPER, Judge.
Appellant was indicted for assaulting John Reed with the intent to murder him. Upon a trial he was convicted of an aggravated assault, and fined in the sum of three hundred and fifty dollars.
The State’s testimony would indicate that appellant made an unprovoked assault on Mr. Reed, and shot at him with a pistol. The testimony offered on behalf of appellant was that Reed had drawn a pistol and was seeking to get an opportunity to shoot appellant, when appellant drew his pistol and fired.
