Introduction

Plaintiffs, former unionized workers at Pepsi Cola’s now closed Exeter Avenue bottling plant in Detroit, Michigan, have filed a twelve-count Complaint against defendant Pepsi Cola Bottling Company (“Pepsi”) and defendant Local Union No. 337, International Brotherhood of Teamsters, Chauffeurs, Warehousemen and Helpers of America (“Local 337”). Defendant Pepsi has filed a motion to dismiss Counts I, IV, V, and VI; this motion is GRANTED.
