AND NOW, this 21st day of April, 2005, after de novo review of the record and upon due consideration of the magistrate judge’s report and recommendation filed on November 23, 2004, plaintiffs’ objections thereto, and defendants’ opposition to those objections and notices of supplemental authorities, IT IS ORDERED that defendants’ motion to dismiss (Doc.
