MEMORANDUM AND ORDER

This matter is before the court on Defendant’s Motion to Dismiss. (Filing No. 8.) As set forth below, the Motion is granted.
I. BACKGROUND AND SUMMARY OF COMPLAINT
Plaintiff Lassa Nielsen filed her claim in Scotts Bluff County, Nebraska, Small Claims Court on December 5, 2008. (Filing No. 1-2, Attach. 1, at CM/ECF pp. 1-2.)
