The defendant, Patricia T. Powers, gave birth on December 1, 1992, to a healthy baby girl. In a paternity action in *689superior court, the plaintiff, Mark J. Welzenbach, was adjudicated the father of the child.

By a writ dated February 22,1993, the plaintiff initiated this action in tort against the defendant containing five counts: intentional misrepresentation, intentional infliction of emotional distress, negligence, battery in the form of sexual assault, and interference with familial relations.
