Reversing.

Appellant, G-ns Moore, brought this action against appellee, Lawrence Conntv, to recover damages in the sum of $200 for injury to his land • alleged to have been due to the ditching of a public road and the building of a culvert in such manner as to discharge water upon his premises in greater quantities than the natural flow. A demurrer was sustained to the petition, and the petition was dismissed; hence this appeal.
