This writ brings up an order of the Circuit Court of Passaic county confirming a report of commissioners appointed by the court to assess benefits for the construction of a sewer through North Fifth street and other streets in the city of Paterson. The proceedings were taken under an act *457entitled “An act to authorize cities to construct sewers and drains and to provide for the payment of the cost thereof,” approved March 8th, 1882, and its supplements.
