Oscar S. McIntosh was convicted in the district court for Sioux county on a charge of stealing a steer, and sentenced to the penitentiary for an indeterminate period of from one to ten years. As plaintiff in error he has brought the case here for review.
It is first argued that the information does not charge an offense against the laws of this state, for the reason that there is no charge that the steer was taken without the owner’s consent; that it was taken with the intent to deprive the owner of its future use; that it was taken with the intent to convert it to the taker’s use.
