As indicated in the preceding statement, there appear in the evidence in the record only two points of controversy as to facts. By the plaintiff’s evidence it is shown that, to the knowledge of the witnesses, the Stevens derrick had not been operating on the afternoon of September 10, 1906, until about five minutes before the injury to the plaintiff, and then only in the field to the east of that in which appellant was handling and placing channel irons.
