ORDER GRANTING DEFENDANT’S MOTION TO DISMISS INDICTMENT

CLELAND, District Judge.

Pending before the court is Defendant John Allen Laton’s “Motion to Dismiss Indictment,” filed on October 17, 2001. In a one count indictment, Defendant was charged with arson under 18 U.S.C. § 844(i). Specifically, Defendant was charged with maliciously damaging and destroying the building known as the Hen-ning Fire Station by means of fire.
