A rather extended statement of facts is necessary to a full understanding of the questions raised.
The American Savings Bank & Trust Company was a banking corporation under the laws of the state of Iowa. On the 17th day of June, 1932, this corporation went into the hands of a receiver, and L. A. Andrew, superintendent of banking, was duly appointed receiver on that date. The Benner Tea Company was an Iowa corporation, engaged in the wholesale mercantile business.
