On June 24, 1924, a petition was presented to this court by J. A. Huddleston (now deceased) wherein it was alleged that on June 8, 1920, the county court of McDowell County having authorized the same, an order on the sheriff of said' county was drawn in favor of W. W. Whyte for the sum of $25,000, payable out of County Road Class B fund, which order was signed by H. N. Eavenson, who was the president of the said court and by W. W.
