The opinion of the Court of Civil Appeals in this case is reported in 283 S. W. 244. The plaintiff in error, as plaintiff in this case, sought to recover as actual and special damages $32,000 and $20,000 exemplary damages against the defendants in error for trespass alleged to have been committed by them upon property belonging to plaintiff in error. A general demurrer was sustained to the petition by the trial court, and, an appeal having been taken and perfected, the Court of Civil Appeals affirmed the action of the district court.
