MEMORANDUM OPINION

BATES, District Judge.

This matter is before the Court on defendants’ motion to dismiss. For the reasons discussed below, the Court will dismiss this action for lack of subject matter jurisdiction.

I. BACKGROUND

Defendant Melissa Suniga was the Senior United States Probation Officer who prepared plaintiffs presentence investigation report (“PSR”) in September 1998. Compl. ¶¶ 4-5 & Ex.
